SMS Event Invitation Terms

1. Service Description

Hooked is an event-based social networking platform. Event organizers use the Hooked platform to send one-time SMS invitations to their event guests. These messages contain the event name, an access code, and a link to download the Hooked app and join the event.

2. Message Frequency

Each recipient receives a single, one-time, non-recurring SMS per event. Messages are not sent on a scheduled or recurring basis. You will only receive an SMS when an event organizer sends you a specific event invitation.

3. Message and Data Rates

Message and data rates may apply depending on your mobile carrier and plan. Hooked is not responsible for any charges incurred by your mobile carrier for receiving SMS messages.

4. Consent and Opt-In

Hooked sends SMS event invitations on behalf of event organizers. The consent flow works as follows:

1. Guest provides contact information: Guests provide their phone number directly to the event organizer when purchasing a ticket, registering for the event, or through a personal invitation. The organizer's registration or ticketing process includes disclosure that the guest may receive an SMS event invitation.
2. Organizer uploads guest list: The event organizer uploads their guest contact list to the Hooked platform at https://hooked-app.com.
3. Organizer confirms consent: Before sending any invitations, the organizer must check a mandatory consent confirmation checkbox stating: "I confirm I have obtained permission from each recipient to send communications about this event, complying with TCPA, GDPR, etc."
4. Invitation sent: Each guest receives a single SMS invitation with the event name, access code, and app download link.

By providing your phone number to an event organizer for the purpose of event registration or ticket purchase, and with the organizer's disclosure that you may receive an SMS invitation, you consent to receive a one-time SMS event invitation from Hooked on behalf of that organizer.

Organizer Consent Obligations

Event organizers who use the Hooked platform to send SMS invitations bear sole responsibility for consent compliance:

• Prior Consent Required: Organizers must obtain valid, prior express consent from each recipient before uploading their contact information to the Hooked platform
• Consent Records: Organizers must retain records of consent for each recipient, including when and how consent was obtained, for a minimum of 5 years
• Compliance Liability: If a recipient files a complaint or claim under TCPA, GDPR, CAN-SPAM, CASL, or other applicable communications laws, the event organizer is solely liable for such claims
• Platform Reliance: Hooked acts as a messaging platform on behalf of event organizers and relies on the organizer's representation that proper consent has been obtained from each recipient

HOOKED DOES NOT INDEPENDENTLY VERIFY THAT EVENT ORGANIZERS HAVE OBTAINED CONSENT FROM EACH RECIPIENT. THE EVENT ORGANIZER IS SOLELY RESPONSIBLE FOR CONSENT COMPLIANCE UNDER ALL APPLICABLE LAWS INCLUDING THE TELEPHONE CONSUMER PROTECTION ACT (TCPA), GENERAL DATA PROTECTION REGULATION (GDPR), AND CAN-SPAM ACT.

4.1 TCPA Compliance (United States)

SMS messages sent through the Hooked platform comply with the Telephone Consumer Protection Act (TCPA):

• Message Classification: Event invitation messages are transactional/informational in nature (not marketing), as they relate to a specific event the recipient has registered for or been invited to
• Sender Identification: Each message identifies the event organizer and includes the event name
• Opt-Out: Every message includes instructions for opting out (reply STOP)
• Frequency: Recipients receive a single, one-time message per event — not recurring or scheduled messages
• Consent Basis: Messages are sent based on consent obtained by the event organizer during ticket purchase or event registration

4.2 WhatsApp Event Invitations

In addition to SMS, event organizers may choose to send invitations via WhatsApp:

• Message Templates: WhatsApp messages use pre-approved message templates reviewed by Meta (WhatsApp's parent company)
• WhatsApp Terms: WhatsApp messages are subject to WhatsApp's own Terms of Service and Privacy Policy
• Opt-Out: Recipients can block the Hooked WhatsApp Business number to stop receiving messages, or reply "STOP"
• One-Time Only: Like SMS, WhatsApp invitations are single, one-time messages per event

6. Opt-Out

You can opt out of receiving SMS messages at any time by replying STOP to any message you receive from Hooked. After opting out, you will receive a confirmation message and will not receive any further SMS messages from Hooked. You may also text STOP, CANCEL, END, QUIT, or UNSUBSCRIBE to opt out.

8. Privacy and Data Protection

Your phone number and SMS-related data are handled in accordance with our Privacy Policy. Key points:

• Your phone number is stored securely and used solely for sending event invitations
• Mobile phone numbers and information will not be shared with third parties for marketing or promotional purposes
• SMS opt-in data and consent information will not be shared with any third parties
• Your contact data is retained only for the duration of the event and deleted during standard event cleanup (24-48 hours after event expiration)

9. Supported Carriers

SMS messages are delivered via Twilio and are supported on all major US carriers including AT&T, T-Mobile, Verizon, Sprint, and most MVNOs. Delivery is not guaranteed on all carriers. International messaging availability varies by country.
