1. Acceptance of Terms
By accessing and using Hooked ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our service.
2. Description of Service
Hooked is an event-based social networking platform that allows users to connect with other attendees at specific events. The service is designed for temporary use during events and automatically deletes user data when events conclude. Our service includes:
- Event-based profile creation and management
- User discovery and matching features
- In-app messaging and communication
- Event-specific social networking
- Automated photo validation and content moderation
- Event billing and payment processing for organizers
Platform Role: Hooked is a technology platform that facilitates connections between users at events. Hooked does not organize, host, or operate events. Event organizers are independent third parties who use the Hooked platform to enhance their events. Hooked does not employ, control, or direct event organizers or their staff. The relationship between event organizers and Hooked is governed by additional terms set forth in Section 11 (Event Organizer Terms).
3. User Eligibility
You must be at least 18 years old to use our service. By using Hooked, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.
3.1 Device Permissions and Access
By using Hooked, you grant permission for:
- Camera access for profile photo capture
- Photo library access for photo selection
- Push notification delivery for match and message alerts
- Network connectivity for app functionality
You may revoke permissions through device settings, but this may limit app functionality.
4. User Accounts and Profiles
OAuth Authentication
Account Creation: Hooked uses OAuth authentication via Google Sign-In, Apple Sign-In, or Facebook Login. When you sign in, we collect your email address from your chosen authentication provider to create your persistent user account.
Account Structure: Your Hooked account consists of two parts:
- User Account (Persistent): Your email address, authentication provider, display name, and lifetime analytics persist across events until you delete your account
- Event Profiles (Temporary): Each time you join an event, you create an event-specific profile with photos, bio, matches, and messages. These event profiles are automatically deleted 24-48 hours after the event expires
Single Event Rule: You can only participate in one event at a time. To join a new event, you must leave your current event first.
Profile Creation and Responsibilities
When creating event profiles, you agree to:
- Provide accurate and truthful information
- Not create multiple profiles for the same event
- Use appropriate and respectful profile photos that comply with our guidelines
- Keep your profile information up to date
- Submit profile photos that meet validation requirements (one clear face, appropriate content)
Account Deletion
You can delete your entire user account (including all data and lifetime analytics) at any time through:
- App Settings → Delete Account
- Email request to contact@hooked-app.com
- GDPR/CCPA data deletion request
Account deletion is permanent and cannot be undone. All user data, analytics, and active event profiles will be deleted within 30 days (GDPR) or 45 days (CCPA).
5. Acceptable Use and Content Guidelines
You agree not to use the service to:
- Harass, abuse, bully, or harm other users
- Share inappropriate, offensive, or explicit content
- Impersonate others or provide false information
- Use the service for commercial purposes without permission
- Attempt to gain unauthorized access to our systems
- Share personal information of other users without consent
- Use automated systems or bots to interact with the service
- Violate any applicable laws or regulations
- Share content that promotes hate speech or discrimination
- Use the service for dating or romantic purposes outside of event context
5.1 Profile Photo Requirements and Validation
All profile photos undergo automated validation using AI technology powered by AWS Rekognition:
- Face Detection: Photos must contain exactly one clearly visible face
- Content Standards: Photos are automatically rejected for explicit content, violence, hate symbols, drugs, or celebrity faces
- Resubmission: Users may resubmit photos if rejected
- Appeal Process: Users can contest automated rejections by contacting support at contact@hooked-app.com
- Enforcement: Repeated violations may result in account restrictions or suspension
You have the right to request human review of automated photo rejections.
6. Content Moderation and Safety
We are committed to maintaining a safe and respectful environment:
- We reserve the right to review and moderate all content
- Users can report inappropriate behavior or content
- We may remove content or suspend accounts for violations
- Profile photos must be appropriate and non-explicit
- Messages must be respectful and non-harassing
- We do not tolerate hate speech, discrimination, or harassment
6.1 Administrator Access and Moderation
By using Hooked, you acknowledge and agree that authorized platform administrators may access your data for legitimate purposes:
- Investigation: Investigating reports of harassment, abuse, or Terms of Service violations
- Support: Providing customer support and resolving account issues
- Safety: Ensuring platform safety and enforcing community standards
- Legal Compliance: Complying with legal obligations, subpoenas, and court orders
Access Controls and Accountability:
- All admin access requires justification and is logged in our audit system
- Admins must provide a reason before viewing personally identifiable information (PII)
- Email and phone numbers are masked by default and require justification to view
- All admin actions are logged with timestamps, justifications, and notes
- You have the right to request your audit log and contest admin decisions
Moderation Actions:
- Warning: First-time minor violations receive warnings
- Kick: Immediate removal from an event for policy violations
- Suspension: Temporary ban (24 hours to 30 days) for repeated violations
- Permanent Ban: Indefinite account termination for severe or repeated violations
- Appeal: You may appeal any moderation decision through contact@hooked-app.com
7. User Safety and Reporting
Your safety is important to us:
- Report any inappropriate behavior or content immediately
- Do not share personal contact information with strangers
- Meet in public places if you choose to meet someone from the app
- Trust your instincts and report suspicious behavior
- We will investigate all reports within 24-48 hours and take appropriate action
- Contact local authorities if you feel unsafe or threatened
Reporting Mechanisms
- In-App Reporting: Report profiles, messages, and behavior directly through the app
- Anonymous Reporting: Reports can be submitted anonymously
- Review Timeline: All reports reviewed within 24-48 hours
- Appeal Process: Users can appeal moderation decisions through in-app support
Platform Response and Enforcement
- First Violation: Warning and content removal for minor violations
- Second Violation: 24-hour account suspension
- Third Violation: Permanent account ban
- Severe Violations: Immediate permanent ban and law enforcement notification if necessary
- Appeal Response: Human review of all appeals within 72 hours
8. Data and Privacy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices regarding data collection, use, and retention.
Email Communications (Event Organizers)
By creating an event organizer account, you agree to receive email communications from us. Your default email preference is set to receive all communications, including event updates, product announcements, and promotional content. You can modify your email preferences at any time through the Settings page in your organizer dashboard. See our Privacy Policy for full details on email communication preferences.
9. Third-Party Services
Our service uses third-party services including OAuth authentication providers (Google, Apple, Facebook), AWS Rekognition, Firebase, OneSignal, Google Analytics, Google Places API, Sentry, and Expo. These services have their own terms of service and privacy policies. By using our service, you acknowledge that these third-party services may process your data in accordance with their respective policies.
Key Third-Party Services:
- Google Sign-In (Google LLC): OAuth authentication and email collection
- Apple Sign-In (Apple Inc.): OAuth authentication and email collection
- Facebook Login (Meta Platforms, Inc.): OAuth authentication and email collection
- AWS Rekognition: Photo validation and content moderation
- Firebase: Database, storage, and cloud functions
- OneSignal: Push notification delivery to your devices
- Google Analytics: Website analytics and usage tracking
- Google Places API: City autocomplete on event submission forms
- Sentry: Error monitoring and performance tracking
- Expo: Cross-platform app development framework and OTA updates
- Google reCAPTCHA: Bot protection on website forms
- Vercel: Website hosting infrastructure
- Firebase App Check: App integrity verification (Apple App Attest / Google Play Integrity)
- Firebase Crashlytics: Crash reporting and diagnostics
- Firebase Analytics: App usage analytics
- TinyURL: URL shortening for event promotion links
- Stripe: Exclusive payment processor for all transactions globally
- Green Invoice: Israeli tax document generation (tax receipts and credit notes)
- Mapbox: Map rendering for venue discovery
- SendGrid (Twilio): Transactional email delivery for organizer notifications
OAuth Provider Data Collection: When you authenticate via Google, Apple, or Facebook, we only collect your email address. We do not access your contacts, friends lists, or other social media data. See our Privacy Policy Section 8 for links to each provider's privacy policy.
9.1 Use of Artificial Intelligence
Hooked uses AI and automated systems for:
- Profile photo validation and content moderation (AWS Rekognition)
- Safety and security monitoring
- Fraud prevention and abuse detection
- Service improvement and analytics
Your Rights: You have the right to contest automated decisions, request human review, and understand how AI affects your experience. Automated decisions do not produce legal or similarly significant effects on your rights.
9.2 AI-Generated Content
Hooked's Business Mode may generate AI-powered professional summaries of user profiles using OpenAI technology. Regarding AI-generated content:
- AI-generated summaries are created from user-provided bio and profile information
- AI classifications (expertise areas, seniority level, focus areas) are algorithmic estimates and may be inaccurate
- AI-generated content does not represent Hooked's views, endorsement, or assessment of any user
- Users should not rely solely on AI-generated summaries when making decisions about other users
- AI embeddings are used for semantic similarity in discovery but do not guarantee compatibility
AI-GENERATED CONTENT IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND MAY BE INACCURATE, INCOMPLETE, OR MISLEADING. HOOKED MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF AI-GENERATED CONTENT.
10. Event-Specific Terms
User Accounts vs Event Profiles
Important Distinction: Your Hooked account consists of two separate data layers:
- User Account (Persistent): Your email address, authentication provider, display name, and lifetime analytics persist across all events until you manually delete your account
- Event Profiles (Temporary): Each time you join an event, you create an event-specific profile with photos, bio, matches, and messages. These event profiles are automatically deleted 24-48 hours after the event expires
Event Profile Rules
Hooked is designed for event-specific use with the following rules:
- Automatic Deletion: Event profiles (photos, bio, matches, messages) are automatically deleted within 24-48 hours after events expire
- New Profile per Event: Each event requires creating a new event-specific profile
- No Cross-Event Data: Matches and conversations do not persist between events
- Single Event Rule: You can only be visibly active in one event at a time. You must leave your current event before joining another
- Event-Specific Data: Profile data (photos, bio) is specific to each event and does not transfer between events
- User Analytics Persist: While event profiles are deleted, your lifetime analytics (events joined, total matches count, etc.) persist with your user account
- Event Codes Required: You must have a valid event code provided by event organizers to participate
- Organizer Terms: Event organizers may have additional terms specific to their events
Attendee Data Visible to Event Organizers
Paid Events (Basic, Pro, Enterprise): When you join a paid event, the following limited data is shared with the event organizer for event management purposes:
- Your first name and contact information (email address if you signed in via Google, Apple, or Facebook; phone number if you signed in via Phone Authentication on iOS)
- When you joined the event and whether you are currently active
Organizers do not have access to your profile photos, bio, interests, matches, likes, messages, gender preferences, location data, or any Business Mode data. See our Privacy Policy Section 4 for the full list of what is and is not shared.
Free Events: Organizers of free-tier events do not receive attendee email addresses or personal data.
By joining a paid event, you consent to this limited data sharing. If you do not wish to share your data with the event organizer, do not join the event.
Leave Event Behavior
When you use the Leave Event feature (Settings → Leave Event):
- Profile Hidden: Your profile becomes immediately hidden from other users in that event
- Data Preserved: Your matches, messages, and profile information remain stored (but hidden) until the event expires
- Rejoin Capability: You can rejoin the same event and your matches and conversations will be restored
- Join New Events: You can join a different event immediately after leaving, without waiting for the old event to expire
- Automatic Deletion: All event data is permanently deleted within 24-48 hours after the event expires, regardless of when you left. See our Privacy Policy for detailed deletion timelines and processes
- No Manual Deletion: You cannot manually delete your data before the event expires. Data deletion is automatic when the event ends
11. Event Organizer Terms
11.1 Applicability
This section applies to users who create events on the Hooked platform ("Event Organizers"). By creating an event, you agree to these additional terms in addition to all other provisions of these Terms of Service. If there is a conflict between this section and other provisions, this section prevails for organizer-specific matters.
11.2 Organizer Representations and Warranties
By creating an event on Hooked, you represent and warrant that:
- You have the legal authority and capacity to host the event and to enter into this agreement
- You are in compliance with all applicable local, state, national, and international laws and regulations related to your event, including health and safety regulations, capacity limits, and accessibility requirements
- You have obtained all necessary permits, licenses, and insurance required for your event
- You have the legal right to use the venue for the stated event at the stated time
- All event information you provide (name, date, time, location, description) is accurate, complete, and not misleading
- You will promptly update event information on the platform if any details change
- Your event does not promote illegal activity, hate speech, violence, or discrimination
11.3 Organizer Consent and Communication Responsibilities
When event organizers upload guest contact lists (phone numbers, email addresses) for the purpose of sending event invitations via SMS, WhatsApp, or email through the Hooked platform:
- Consent Responsibility: The event organizer is solely responsible for obtaining valid, prior express consent from each recipient before uploading their contact information to the Hooked platform
- Lawful Basis: Organizers must have a lawful basis (consent, legitimate interest, or contractual necessity) for providing guest contact data to Hooked for invitation delivery
- Consent Records: Organizers must retain records of consent for each recipient, including when, how, and in what context consent was obtained, for a minimum of 5 years
- Regulatory Compliance: Organizers are solely liable for any claims, fines, penalties, or legal actions arising from unauthorized communications, including violations of the Telephone Consumer Protection Act (TCPA), General Data Protection Regulation (GDPR), CAN-SPAM Act, Canadian Anti-Spam Legislation (CASL), or any other applicable communications law
- Consent Confirmation: Before sending any invitations, organizers must confirm via the mandatory consent checkbox that they have obtained permission from each recipient

THE EVENT ORGANIZER, NOT HOOKED, IS RESPONSIBLE FOR OBTAINING AND MAINTAINING PROPER CONSENT FROM ALL RECIPIENTS BEFORE UPLOADING CONTACT INFORMATION TO THE HOOKED PLATFORM. HOOKED DOES NOT INDEPENDENTLY VERIFY THAT ORGANIZERS HAVE OBTAINED CONSENT. IF A RECIPIENT FILES A COMPLAINT OR LEGAL CLAIM RELATED TO UNAUTHORIZED COMMUNICATIONS, THE EVENT ORGANIZER IS SOLELY LIABLE.
11.4 Organizer as Data Controller
For the purposes of SMS, WhatsApp, and email outreach to guest contact lists:
- Data Controller: The event organizer acts as the data controller, determining the purposes and means of processing guest contact data (i.e., sending event invitations to their guests)
- Data Processor: Hooked acts as the data processor, processing guest contact data solely on the organizer's instructions and for the limited purpose of delivering event invitations
- Controller Obligations: Organizers acknowledge their obligations as data controllers under GDPR (where applicable), including providing privacy notices to data subjects, responding to data subject access requests, and maintaining records of processing activities
- Sub-Processors: Hooked uses Twilio as a sub-processor for SMS and WhatsApp message delivery. By using the invitation feature, organizers authorize this sub-processing arrangement
11.5 Event Accuracy and Responsibility
- Event organizers are solely responsible for the accuracy of all event information including event name, date, time, location, and description
- Hooked does not verify, validate, or endorse event details and is not liable for inaccurate, incomplete, or misleading event information
- Organizers must promptly update event information if any details change and must notify attendees of material changes
- Hooked is not responsible for any losses, damages, or inconvenience caused by inaccurate event information provided by organizers
11.6 Organizer Indemnification
Event organizers agree to indemnify, defend, and hold harmless Hooked, its parent companies (Hooked Interactive Ltd and Hooked Social Inc), officers, directors, employees, agents, and affiliates from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to:
- The organizer's event, including but not limited to personal injuries, property damage, illness, or any incidents occurring at, during, or in connection with the event
- Unauthorized or non-compliant SMS, WhatsApp, or email communications sent through the Hooked platform on the organizer's behalf
- Violations of TCPA, GDPR, CAN-SPAM, CASL, or any other applicable communications or data protection laws related to the organizer's use of the invitation feature
- Inaccurate, misleading, or fraudulent event information provided by the organizer
- Any violation of these Terms of Service by the organizer
- Claims by third parties (including event attendees, venue operators, and government authorities) related to the organizer's event
- Any intellectual property infringement claims arising from content provided by the organizer
11.7 Tax Responsibility
- Event organizers are solely responsible for determining and fulfilling their own tax obligations arising from event revenue, ticket sales, or any other income related to their events
- Hooked does not provide tax, legal, or accounting advice
- For events held in Israel, Hooked generates Israeli tax-compliant documents (Type 320 tax receipts and Type 330 credit notes) via Green Invoice as a convenience service. The generation of these documents does not constitute tax advice, and the organizer remains solely responsible for their tax compliance and filing obligations
- Any applicable currency conversion fees, foreign exchange rate differences, or bank charges incurred during payment processing are the organizer's responsibility
- Organizers are responsible for collecting and remitting any applicable sales tax, VAT, or other transaction taxes related to their events
11.8 Attendee Data Access
Organizers of paid events (Basic, Pro, or Enterprise tier) may access limited attendee data for event management purposes:
- Data Provided: Attendee first name, contact information (email address or phone number, depending on authentication method), join timestamp, and active status
- Access Period: Data is accessible while the event is active and for up to 48 hours after event expiration, after which it is deleted from the platform
- Audit Logging: All attendee data views and exports by organizers are logged in our audit system
Organizers must NOT:
- Use attendee data for marketing, advertising, or promotional purposes without obtaining separate, explicit consent directly from the attendee
- Sell, lease, rent, trade, or otherwise transfer attendee data to any third party
- Use attendee data to build marketing lists, CRM databases, or audience profiles beyond the scope of the specific event
- Contact attendees for purposes unrelated to the specific event they attended
- Retain attendee data longer than reasonably necessary for event follow-up (e.g., post-event thank you, feedback requests). Hooked recommends deleting exported data within 30 days after the event
Violations of these data access restrictions may result in immediate termination of your organizer account, permanent ban from the Hooked platform, and legal action for damages.
11.9 Free Tier Limitations
The Free tier (up to 30 attendees) provides basic event functionality. The Free tier does NOT include:
- Priority customer support (standard response times apply)
- Advanced analytics or detailed engagement metrics
- SMS, WhatsApp, or email invitation delivery through the platform
- Social media promotion or marketing support
- Custom branding or white-label features
- Guaranteed uptime SLAs
- Access to attendee email addresses or personal data (organizers see aggregate attendance counts only)
Hooked reserves the right to modify Free tier features, impose additional limitations, or discontinue the Free tier at any time with reasonable notice.
12. Intellectual Property
The service and its original content, features, and functionality are owned by Hooked and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of content you create, but grant us a license to use it for service provision.
13. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties. Upon termination, your right to use the service will cease immediately.
14. Limitation of Liability
In no event shall Hooked, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.
15. Digital Service Delivery
Hooked provides digital event access services. Upon successful payment by event organizers:
- Immediate Confirmation: You will receive a confirmation email with your event access details
- Event Code Delivery: Your unique event QR code or access code will be delivered to your registered email address
- Dashboard Access: Event organizers can immediately access their dashboard at hooked-app.com/organizers
Delivery Method
- All digital access codes and event materials are delivered electronically via email
- No physical products are shipped
- Access is granted within minutes of successful payment processing
Access Issues
If you do not receive your confirmation email within 30 minutes of payment, please check your spam/junk folder and contact contact@hooked-app.com with your payment confirmation.
16. Billing and Payments
Pricing Tiers
Event organizers pay per-event based on the maximum number of attendees:
- Free Tier: Up to 30 attendees — no charge
- Basic Tier: 31–100 attendees — $150 USD / ₪350 ILS
- Pro Tier: 101–200 attendees — $250 USD / ₪500 ILS
- Enterprise Tier: 200+ attendees — custom pricing (contact us)
Pricing is subject to change. The price displayed at the time of purchase is the price you will be charged.
Payment Processor
All payments are processed exclusively by Stripe, Inc. Stripe handles all credit/debit card payments, Apple Pay, Google Pay, refunds, and saved payment methods globally, regardless of event country or currency (USD, ILS, EUR, GBP).
For events held in Israel, we additionally use Green Invoice to generate Israeli tax-compliant invoices (Type 320 tax receipts) and credit notes (Type 330). Green Invoice does not process payments or store card details.
Payment method details (card number, CVV, expiry) are collected and stored by Stripe, not by Hooked. See our Privacy Policy for details.
Contracting Entities
Your contractual relationship is with one of the following entities, determined by the country of the event (not the organizer's location):
- Events held in Israel: Contracted with Hooked Interactive Ltd, an Israeli company
- All other events worldwide: Contracted with Hooked Social Inc, a US company
Both entities operate the same Hooked platform and provide the same services. Your rights under these Terms apply regardless of which entity is your contracting party.
Tier Upgrades
Event organizers can upgrade their event tier at any time to increase attendee capacity:
- Upgrade Paths: Free → Basic, Free → Pro, or Basic → Pro. Downgrades are not supported
- Pricing: You are charged the difference between your current tier price and the target tier price. If a discount was applied to your original purchase, the same discount percentage carries forward to the upgrade price
- Zero-Cost Upgrades: If the price difference after discount is zero, the upgrade is processed without a charge
Automatic Tier Upgrades (Auto-Upgrade)
Event organizers can opt in to automatic tier upgrades to prevent attendee capacity from being reached:
- Opt-In Required: Auto-upgrade is disabled by default. Organizers must explicitly enable it and save a payment method
- How It Works: When your event reaches its maximum attendee capacity and a new user attempts to join, the system automatically upgrades your event to the next tier and charges your saved payment method
- Saved Payment Method: A tokenized reference to your payment method is stored securely to enable automatic charges. You can remove your saved payment method at any time, which disables auto-upgrade
- Notifications: You will receive an email notification immediately when an auto-upgrade charge is processed, whether successful or failed
- Toggle Control: You can enable or disable auto-upgrade at any time through your organizer dashboard or the mobile app
- Pricing: Auto-upgrades are charged at the same rate as manual upgrades (difference between current and next tier price, with any applicable discount)
Discount Codes
Promotional discount codes may be offered that reduce the event price:
- Discount codes may be percentage-based or fixed-amount
- Codes may have usage limits, expiration dates, or restrictions on event types or countries
- If a discount was applied to the original event purchase, the same discount percentage carries forward to any tier upgrades
Receipts
Digital receipts for all transactions are available through the billing section of your organizer dashboard (web and mobile). Receipt URLs are also included in confirmation emails.
Social Promotion and Marketing
Hooked may, at its sole discretion, promote select events through its social media channels, website, or other marketing materials. Such promotion is not guaranteed and does not form part of any service tier or pricing package. Specifically:
- Social media promotion (Instagram, TikTok, or other platforms) is provided at Hooked's discretion and is not included as part of any event tier (Free, Basic, Pro, or Enterprise)
- Hooked is under no obligation to promote, advertise, or market any event — whether free or paid
- The selection of events for promotion is determined solely by Hooked based on factors including but not limited to: event type, audience fit, timing, and partnership agreements
- Event organizers may not claim or imply that Hooked endorses or sponsors their event unless a separate written agreement exists
17. Refund and Cancellation Policy
Event Organizer Refunds
Refund eligibility is determined by how far in advance of the event you request cancellation:
- Full Refund (100%): Available if cancellation is requested 7 or more days before the event start date. Processed automatically
- Partial Refund (75%): Available if cancellation is requested less than 7 days before the event start date but before event access opens. Processed automatically
- No Refund (0%): Once event access is active, no refunds are available
Important — Early Access Events: If your event is configured with early access (allowing attendees to join before the official event start date), the "no refund" period begins when access opens, not at the event start date. This means the refund window may close earlier than the event start date.
How to Request a Refund
You can request a refund through:
- In-App: Use the refund request feature in your organizer dashboard (recommended — fastest processing)
- Email: Contact us at contact@hooked-app.com with your event name and reason for cancellation
Eligible refunds are processed automatically. Refunds are returned to the original payment method within 5–10 business days.
Payment Disputes and Chargebacks
If you file a payment dispute (chargeback) with your bank or card issuer, we will respond with transaction evidence. Fraudulent or abusive disputes may result in restrictions on your organizer account.
- Refund First: We strongly encourage organizers to use Hooked's refund process (Section 17) before filing a chargeback with their bank. Filing a chargeback without first requesting a refund through Hooked may be considered a fraudulent or abusive dispute
- Consequences: Fraudulent or abusive chargebacks may result in: immediate suspension of your organizer account, recovery of the disputed amount plus any chargeback fees incurred by Hooked, and potential legal action for damages
- Evidence Submission: Hooked reserves the right to submit all available transaction evidence (payment confirmation, service delivery records, communication logs) to card networks and financial institutions in response to any dispute
Auto-Upgrade Consent
By enabling the auto-upgrade feature and saving a payment method, you expressly authorize Hooked to automatically charge your saved payment method when your event reaches its current tier's attendee capacity. Each auto-upgrade is a separate authorized transaction at the published tier upgrade price (with any applicable discount). You will receive an email notification for each auto-upgrade charge, whether successful or failed. You may revoke this authorization at any time by disabling auto-upgrade or removing your saved payment method in your organizer dashboard.
18. Disclaimers
The service is provided on an "AS IS" and "AS AVAILABLE" basis. Hooked makes no warranties, expressed or implied, and hereby disclaims all warranties, including without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted or error-free.
18.1 No Background Checks
HOOKED DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS, IDENTITY VERIFICATION, SEX OFFENDER REGISTRY CHECKS, OR ANY OTHER SCREENING ON ITS USERS. HOOKED MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT, IDENTITY, INTENTIONS, LEGITIMACY, OR VERACITY OF USERS. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. ALWAYS EXERCISE CAUTION AND USE YOUR BEST JUDGMENT WHEN COMMUNICATING WITH OR MEETING OTHER USERS.
18.2 Assumption of Risk
YOU ACKNOWLEDGE AND AGREE THAT YOU ASSUME ALL RISK WHEN USING THE HOOKED PLATFORM AND WHEN INTERACTING WITH OTHER USERS, WHETHER ONLINE THROUGH THE APP OR IN PERSON AT EVENTS. YOU AGREE THAT HOOKED IS NOT RESPONSIBLE FOR THE ACTS OR OMISSIONS OF USERS ON OR OFF THE PLATFORM, INCLUDING BUT NOT LIMITED TO ANY DAMAGES, INJURIES, OR HARM ARISING FROM YOUR INTERACTIONS WITH OTHER USERS.
18.3 No Guarantee of Results
HOOKED DOES NOT GUARANTEE THAT YOU WILL RECEIVE ANY MATCHES, CONNECTIONS, MESSAGES, OR PARTICULAR OUTCOMES FROM USING THE SERVICE. THE NUMBER AND QUALITY OF CONNECTIONS DEPEND ON MANY FACTORS OUTSIDE OF HOOKED'S CONTROL, INCLUDING BUT NOT LIMITED TO THE NUMBER OF ATTENDEES AT AN EVENT, USER PREFERENCES, AND INDIVIDUAL BEHAVIOR.
18.4 Identity and Catfishing Disclaimer
Hooked cannot and does not guarantee the identity of any user on the platform:
- Our photo validation technology (powered by AWS Rekognition) detects the presence and count of faces in profile photos, but it does not verify the identity of the person in the photo
- Profile information (name, bio, age, interests) is self-reported by users and is not independently verified by Hooked
- Despite our safety measures, including photo validation and content moderation, we cannot guarantee that every user is who they claim to be
- Users may misrepresent themselves, use photos that are not their own, or provide false information (commonly known as "catfishing")
You should exercise caution, use your best judgment, and not rely solely on profile information or photos when interacting with other users. Report suspected fake profiles immediately using the in-app report feature.
18.5 Event Safety Disclaimer
HOOKED IS A TECHNOLOGY PLATFORM AND DOES NOT ORGANIZE, HOST, MANAGE, SUPERVISE, OR CONTROL EVENTS. HOOKED IS NOT RESPONSIBLE FOR THE SAFETY, CONDITIONS, QUALITY, LEGALITY, OR CONDUCT AT ANY EVENT. EVENT ORGANIZERS ARE SOLELY RESPONSIBLE FOR ALL ASPECTS OF THEIR EVENTS INCLUDING VENUE SAFETY, COMPLIANCE WITH LOCAL LAWS, AND ATTENDEE WELLBEING.
- Hooked does not inspect, monitor, or control event venues or their conditions
- Hooked does not endorse, vet, or screen event organizers, venues, or events
- Users voluntarily attend events and assume all inherent risks associated with attending public or private gatherings, including but not limited to the risk of illness, injury, disability, or property damage
- Users are responsible for their own safety at events and should take reasonable precautions, including being aware of their surroundings and following venue safety guidelines
- Hooked does not provide security personnel, medical services, or any on-site safety infrastructure at events
18.6 GPS and Location Disclaimer
GPS and location-based features have inherent accuracy limitations. Location verification is approximate and may be affected by device settings, signal strength, indoor environments, atmospheric conditions, and other factors beyond Hooked's control. Hooked does not guarantee the accuracy of GPS-based attendance verification and is not liable for any consequences arising from GPS inaccuracies. Users should not rely on Hooked's GPS features for personal safety purposes.
18.7 User Communications
Hooked is not responsible for the content of messages exchanged between users through the platform. Users are solely responsible for their communications. Hooked does not monitor or review messages in real time — content moderation occurs upon user report. While we provide tools for reporting inappropriate messages and take action against policy violations, we cannot prevent all harmful communications. If you receive threatening, harassing, or inappropriate messages, report them immediately and contact local authorities if you feel unsafe.
18.8 Meeting in Person
If you choose to meet someone you connected with through Hooked, whether at the event or afterward, you do so entirely at your own risk. Hooked strongly recommends meeting in public places, informing a friend or family member of your plans, arranging your own transportation, and trusting your instincts. Hooked is not responsible for any interactions, incidents, injuries, or damages that occur outside the platform, including but not limited to in-person meetings arranged through the app. See our Code of Conduct for detailed safety tips.
18.9 No Endorsement of Events or Organizers
The listing, display, or promotion of an event on the Hooked platform does not constitute endorsement, sponsorship, recommendation, or vetting by Hooked. Hooked does not verify the quality, safety, legality, suitability, or accuracy of any event listed on the platform. Users should exercise their own judgment when deciding whether to attend an event and should independently verify event details, venue conditions, and organizer credentials when possible.
19. Indemnification
You agree to indemnify, defend, and hold harmless Hooked, its parent companies (Hooked Interactive Ltd and Hooked Social Inc), and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to:
- Your use of or inability to use the Service
- Any content you post, upload, or transmit through the Service (including profile information and photos)
- Your interactions with other users, whether online or in person
- Your attendance at or participation in any event where Hooked is used
- Any violation of these Terms of Service by you
- Any violation of applicable law or regulation by you
- Any claims by third parties arising from your conduct on or off the platform
This general indemnification is in addition to, and does not limit, the organizer-specific indemnification obligations set forth in Section 11.6 (Organizer Indemnification). Event organizers are subject to both this general indemnification and the organizer-specific indemnification.
20. Governing Law and Dispute Resolution
These Terms shall be interpreted and governed by the laws of the jurisdiction in which Hooked operates, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration or in the courts of our jurisdiction.
21. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
22. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the service after changes become effective constitutes acceptance of the new terms.
